Terms & Conditions

These Terms and Conditions apply when you buy, book, pay for or use anything offered through www.jodie-louise.com. They are an agreement between you and Jodie Louise, ABN 25 815 100 470, trading as Jodie Louise and The Nourished Woman, who is the seller of all products and services on this website. By placing an order, paying an invoice or making a booking, you agree to these Terms.

Services & inclusions

Jodie Louise will provide a variety of services both face-to-face and online. Services may include online wellness coaching, general nutrition and lifestyle education, wellness programs, books, workshops and retreats. Jodie Louise is a wellness educator and is not a registered medical practitioner, nutritionist or dietitian. All services are educational and are not a substitute for medical care. All inclusions will be listed on your invoice. If it is not listed, it is not included. If you are unsure of what is and isn’t included, please contact Jodie Louise prior to making payment.

Orders & payment

When you place an order through this website you are making an offer to buy. A contract is formed when I send you an order confirmation email. Until then I may decline an order, and if I do you will be refunded in full.

All prices on this website are in United States dollars (USD) and are the total amount payable. Prices are labelled USD wherever they appear. Your bank or card issuer may apply its own currency conversion rate or an international transaction fee. I do not receive those amounts and cannot control them.

I am not currently registered for GST, so no GST is charged.

Payment is processed by Stripe. I do not see or store your full card details.

If a price or product description is obviously wrong, for example a decimal point in the wrong place, I may cancel your order before it is fulfilled. If I do, I will tell you promptly and refund you in full, or you may choose to go ahead at the correct price. This applies only to genuine and obvious errors.

Digital products

E-books, guides, recorded workshops and other downloadable materials are licensed to you personally. You may keep them, read them and print a copy for your own use. You may not share, resell, redistribute, upload or reproduce them, in whole or in part, and you may not use them to teach or train others commercially.

Access to recorded workshops is for life. If I ever need to retire a product or close the platform it sits on, I will email everyone who has bought it, well in advance, so you have time to download and keep your copy.

Because digital products are delivered instantly and cannot be returned once accessed, they are generally non-refundable once downloaded. This does not affect your rights under the Australian Consumer Law. If a digital product is faulty, not as described, or does not do what I said it would, you may be entitled to a remedy.

Affiliate & third party products

Some links on this website are affiliate links, and I earn a commission if you buy through them, at no additional cost to you. Affiliate links are labelled where they appear.

Where you buy a product from a third party seller, your purchase is a contract between you and that seller. Delivery, shipping, refunds, warranties and any issue with the product are governed by that seller’s terms and conditions, not these Terms. I am not the supplier or manufacturer of those products and I am not responsible for them, although consumer guarantees under the Australian Consumer Law may still apply against the relevant supplier or manufacturer.

Product information, ingredients, dosage and safety warnings come from the manufacturer. Always read the label, follow the directions for use, and speak to your doctor or a qualified practitioner before starting anything new, particularly if you are pregnant, breastfeeding, taking medication, or living with a health condition.

Session fees & refunds

Fees are variable and should be negotiated before a session takes place. If you are unsure of the payment arrangement, it is your responsibility to ask for clarity before proceeding to work with Jodie Louise. Refunds are not generally offered for change of mind once payment is made. However, nothing in these terms limits your rights under the Australian Consumer Law, including the consumer guarantees that cannot be excluded. If a product or service is faulty, not as described, or not fit for its purpose, you may be entitled to a refund, repair or replacement. Beyond those rights, Jodie Louise is always happy to discuss a fair solution wherever possible.

Missed sessions & cancellation

You are required to give 24 hours’ notice if cancellation is required. If you cancel with less than 24 hours’ notice, or do not attend, the session fee is forfeited, because the time was reserved for you and cannot be filled at short notice. Where something genuinely outside your control prevents you attending, such as illness, bereavement or an emergency, please tell me and I will reschedule you at no charge. Please notify Jodie Louise in writing at your earliest convenience if a session will be missed.

If you cancel, any deposit reflects costs Jodie Louise has already reasonably incurred and time reserved for you, and to that extent is non-refundable and non-transferable.

Nothing in this clause affects your rights under the Australian Consumer Law, and Jodie Louise will refund any part of a deposit that exceeds her reasonable costs where the law requires it or where it is fair to do so in the circumstances.

Provide as much information as possible in your cancellation request for Jodie Louise to consider.

Retreats, workshops & in-person events

Booking. Your place is confirmed when your payment or deposit is received.

If you cancel. Fees and deposits for in-person events are non-refundable. They reflect the place held for you, the time reserved, and the planning, venue and booking costs I have already committed on your behalf. If you can no longer attend, please tell me as soon as possible. You are very welcome to pass your place to someone else, or to find someone to take it, and I will transfer the booking across at no charge once you tell me who they are. If your place is filled, I will look at refunding you, and I will consider every situation on its own facts. What I cannot do is refund a place that stays empty.

If I cancel or postpone. If I cancel an event, you will receive a full refund of everything you have paid, or a credit toward a future event, whichever you prefer. If I postpone, you may take the new date or take a full refund. In either case I am not responsible for travel, accommodation or other costs you have booked separately.

Travel insurance. If you are travelling outside your own country to attend, you are required to hold travel insurance covering cancellation, medical costs and repatriation.

Health. Before attending you must tell me about any medical condition, medication, injury, pregnancy, or history of disordered eating that could affect your participation. I may decline or limit your participation in any activity on health or safety grounds. Some activities are physical and you take part voluntarily.

Behaviour. I may ask a participant to leave an event without refund where their conduct puts the safety or wellbeing of others at risk.

Your rights. Nothing in this section limits your rights under the Australian Consumer Law, including where an event is not delivered as described.

Payment terms

Payment instructions are detailed on your quote/invoice.

Price changes

Jodie Louise reserves the right to vary prices and rates in the event of changes in exchange rates or price rises made by wholesalers or other suppliers. Any price change applies only to new orders or bookings made after the change takes effect. Where you have already booked and paid for a service, the price agreed at the time of booking will not increase.

If, before a service is delivered, Jodie Louise notifies you of a price increase that would affect your booking, you may choose not to proceed and receive a refund of any amounts you have paid for services not yet delivered.

Rates quoted are appropriate to the product at the time of quoting/invoicing, and these rates may change. All prices are subject to availability.

Communication errors

Every effort is made to keep the information on this website accurate. Where an obvious error appears in a price or a description, the process in the Orders and payment section above applies: I will tell you, and you will be refunded in full or may choose to go ahead at the correct price. I am not otherwise responsible for typographical errors or for errors arising from circumstances outside my control.

Confidentiality

Jodie Louise shall maintain the confidentiality of all that may be disclosed in the course of providing her services. For the avoidance of doubt, confidential information does not include information which is public knowledge, was in the recipient’s possession before receipt, or is independently developed by the recipient.

Liability

The books, programs, and website content provided by Jodie Louise through www.jodie-louise.com are designed for educational and informational purposes only. They are not a substitute for medical advice, diagnosis, or treatment. Please consult a healthcare professional before making any dietary or lifestyle changes, particularly if you have an existing condition, are pregnant, or are trying to conceive.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. Where the Australian Consumer Law permits Jodie Louise to limit her liability for a failure to comply with a guarantee, that liability is limited (at her option) to resupplying the services or paying the cost of having them resupplied.

Subject to those rights, and to the maximum extent permitted by law, Jodie Louise is not liable for any indirect, incidental, special or consequential loss, or for any loss you claim to have incurred in seeking to improve your quality of life, wellness or other personal goals.

Jodie Louise shall not be held responsible for factors beyond reasonable control, including delays and non-performance caused by viruses, denial of service attacks, other acts or omissions by third parties, Internet service providers, by you or its contractors, strikes, lockouts, work slowdowns or stoppages, accidents, fires, acts of God, terrorism.

Indemnity

You agree to indemnify Jodie Louise against liabilities, costs and expenses that she reasonably incurs arising from your breach of these Terms, your misuse of the services or content, or information you supply that is inaccurate or unlawful.

This indemnity does not apply to the extent any liability, cost or expense is caused by Jodie Louise’s own negligence or breach, and nothing in this clause requires you to indemnify Jodie Louise against any liability that cannot lawfully be excluded or in a way that would make this clause an unfair contract term under the Australian Consumer Law.

Changes to these Terms

I may update these Terms from time to time. The version published on this page at the time you place an order or make a booking is the version that applies to that order or booking.

Governing law

These Terms are governed by the laws of Queensland, Australia, and you and I submit to the non-exclusive jurisdiction of the courts of that State. Nothing in this section limits any right you have under the Australian Consumer Law, or under the law of your own country where that law applies to you.
